On September 4, 1999, after years of fruitless struggle with Cayuga County Family Court, Child Protection Services and Special Education officials, my thirteen-year old autistic son Daniel Michael Leubner died when his house burned as he slept. Eighteen days after his death his mother, Michelle Davis, was charged with his murder. Initially indicted on Murder 1 and Arson 2 charges, she was allowed to plead to Manslaughter 1 and Arson 2 when Judge Peter Corning (the same Family Court judge that repeatedly refused my requests for assistance concerning my children's welfare) embraced and promoted her incredible, repugnant and unfounded claim that Danny had raped her the night of the fire. Without one shred of evidence to support her Extreme Emotional Disturbance plea, this cold-blooded murderer was sentenced to serve a mere six-year prison term.

I have spent the last eight years trying to prevent, and then undo, this absolute perversion of justice. To this end I personally met then-New York State Attorney General Eliot Spitzer in October 2002 and, per his instructions, filed three separate complaints with the Syracuse and Albany AG offices regarding crimes committed by Cayuga County officers of the court. Unfortunately Judge Peter Erastus Corning (a scion of the historically corrupt New York State Democratic Corning machine as well as a former Hoover-era FBI agent with an extremely controversial past) seems to have been able to keep this story under wraps and out of the public spotlight. Despite the overwhelming amount of evidence supporting my argument Eliot Spitzer repeatedly ignored my formal complaints and, as a result, Danny's murdering mother was released in May 2005.

I have assembled the entire case file (including evidence that the Attorney General's office had indeed received my complaints, as well as a statement from Davis's ex-husband repudiating her alibi and defense claims) and created this page. Although Danny's murderer has already been released I still believe that justice may be served by exposing this travesty to a wide audience. Please read it through, consider my arguments, and then pass it along to as many people as possible. As I previously stated, then-Attorney General (and now disgraced former New York State Governor) Eliot Spitzer repeatedly pretended that he hadn't received my formal complaints, opting instead to protect a indisputably corrupt judge by refusing to enforce the laws he is sworn to uphold. By making this choice Eliot. Spitzer not only placed politics above justice by defending a corrupt judicial system that refused to properly address a renegade judge who substituted his own personal beliefs in lieu of state and federal law, he also put the general public at great risk by releasing a confessed arsonist and child-killer (the fire that killed Danny was the FOURTH at this house). To put it bluntly, if anyone else falls victim to Michelle Davis Eliot Spitzer and New York State will surely share the blame and liability.

A MESSAGE FOR AMERICA - AUTISM IS NOT A CRIME!!!

Danny was a completely innocent boy whose only crimes were to be born autistic and to trust his mother. Justice was not only denied in this case, but the wholesale acceptance of perjury and the refusal to address the actual facts and issues in this case places the integrity of the entire New York State Judicial System in doubt. This disgusting case only demeans the lives of disabled children everywhere, displays the dearth of justice afforded autistic children and deserves the infamy publicity will most certainly bring. I plead with you; spread this story far and wide. Although retrying Danny's murdering mother is not a likely prospect, she could certainly face federal prosecution for violating his civil rights. Daniel Michael Leubner deserves his day in court; New York cannot truthfully state that it is just until this happens. I couldn't prevent his death, please help me secure justice for Danny.
